The Accelerated Border Procedure

Three Phases:

1) Stating Clearly that You Will Be Petitioning for International Protection

You can manifest at any point your intention to file a request for international protection. Beginning on June 12 to October 31, 2026, the offices who have been charged with accepting your request are the Questura (local police department,) and the Border Police Stations.

2) Registration of the Request

Within five days of when you have declared that you will petition for international protection, your request must be filed. During this phase your photo will be entered in the Eurodac System (EU Agency for Asylum,) and an ID will be given to you with a unique identification code and the date in which the request was filed.

3) Formalizing the Request

Within 5 days of the filing, your request must be formalized. You must gather, if available, all useful documentation with regard to your request for international protection. Following formalization a document (for example: a residence permit due to asylum request).

BEWARE

  • ALL THE REQUESTS FOR INTERNATIONAL PROTECTION FILED FROM JUNE 12 TO OCTOBER 31, 2026, WILL BE CONSIDERED FORMALIZED FROM THE MOMENT THAT THEY ARE REGISTERED.

 

  • IF YOU DO NOT SHOW UP FOR THE APPOINTMENT TO FORMAIZE THE REQUEST. YOUR REQUEST FOR INTERNATIONAL PROTECTION WILL BE CONSIDERED WITHDRAWN. ENSURE THAT ALL COMMUNICATIONS REGARDING YOUR REQUEST FOR PROTECTION WILL REACH YOU.  IN THE INSTANCE THAT YOUR REQUEST IS CONSIDERED WITHDRAWN, AND SHOULD YOU DECIDE TO FILE A SECOND REQUEST, THIS ONE COULD BE CONSIDERED INADMISSABLE AND NOT TAKEN INTO ACCOUNT. 

 

Important:

  • During the screening procedure, which you will undergo right after your arrival, it is fundamental to state every health related condition and each specific need to guarantee access to all covertures foreseen when dealing with someone in a vulnerable state (pregnancy, victim of human trafficking, victim of gender violence, any form of physical and/or mental disability.)
  • For the duration of the procedure at the border, by law you are not authorized to be on Italian territory, therefore you cannot leave the designated entry area (Legal fiction of non-entry in EU.)
  • During the procedure you will be authorized to reside in a reception center to which you have been assigned. A magistrate will rule on this question that will include a list of your duties. In any case you must respect the center’s regulations.
  • In some cases, during the period of the procedure, you can be held near the border area in a center suitable for that purpose.
  • The border procedure can last a twelve-week maximum period starting from the date the request was formally filed.
  • During the 12-week waiting period formal registration, hearing and a decision on the part of the Territorial Commission will take place, including an eventual appeal and decision on the merits and possible suspension.
  • If the border procedure is NOT completed during the 12-week period, you will be then subjected to normal procedure and are entitled to enter the national territory.
  • If you want to appeal against a decision of the Territorial Commission, you must do so within five days of receiving sentence notification. The appeal does not automatically suspend the validity of the decision being appealed. Therefore If you have received a denial and are appealing, your lawyers must ask for the suspension of the negative decision, otherwise you could face repatriation during this time.
  • The repatriation procedure must be carried out within 12 weeks after having received notification of the denial by the Territorial Commission or notification that the Court has not accepted your appeal.
  • If the repatriation procedure is not carried out within 12 weeks, you will receive an expulsion order.
